TravelFly Adventures Terms & Conditions
IDENTIFICATION: Guests are required to make reservations in the full name that is listed on his/her government document they will use for travel. If you need to make any changes to a name after travel documents have been issued, clients will be responsible for all name change fees, if applicable.
SELLER OF TRAVEL: TravelFly Adventures is an independent affiliate of Cruises and Tours Unlimited, which is registered as Florida Seller of Travel Ref. No. ST15578 and California Seller of Travel No. 2090937-50, Washington UBID No.603189022 & Iowa Registered Agency No. 1202.
PAYMENTS AND CANCELLATIONS: Unless otherwise defined during the reservation process, final payment is due prior to departure or consumption according to each supplier’s (airline, hotel, cruise line, transfer company, sightseeing operators, and other travel service vendors) terms and conditions involved in your travel booking. If final and full payment is not received by the applicable due date, reservations are subject to cancellation and deposits shall be forfeited. In some cases, there is NO REFUND once a booking is made and paid for. Your right to a refund if you change or cancel your travel plans is limited. All cancellation requests must be sent to TravelFly Adventures in writing. Because of cancellation, TravelFly Adventures and third-party supplier’s cancellation penalties will apply, which are detailed in your travel documentation and each supplier’s website. TravelFly Adventures charges $100.00 per person if a trip is canceled. The cancellation fee(s) will have to be paid before the trip is fully canceled. Cancellation penalties are advised at time of booking and provided to you upon confirmation. If you have any questions, or any penalties are unclear, please contact your TravelFly Adventures agent. All cancellation fees will be charged to the credit card you authorized to pay for travel services.
PASSPORT AND VISA: Passengers are responsible for ensuring that they have the proper travel documents and MUST CHECK with the respective consulate(s) or visa agency to determine whether any visas or passports are required. Passports are required to be valid for at least 6 months after the date of travel. Some countries require a full blank “VISA” page in the passport for stamping purposes. Any information provided on travel description pertains to US citizens only. Non-US citizens should check with the respective consulate of the country(s) to be visited for current entry requirements. We strongly suggest all cruise passengers to have a valid passport in their possession while cruising.
INDIVIDUAL ENTRY AND EXIT REQUIREMENTS: Each foreign country holds different views of past criminal offenses, whether within or outside of their boundaries. If you have a current or past offense, and you are unsure how the country you are traveling to (or through) views that offense, please contact that country directly for entry and exit requirements. (Details can be found at http://travel.state.gov/travel/cis_pa_tw/cis/cis_4965.html.) We feel it is an invasion of privacy for any member of our staff to make such an inquiry. For example, if traveling to or through Canada, Americans with a Driving While Intoxicated (DWI) record should always check whether current rules exclude admission, and potential waivers. BY OFFERING FOR SALE TRAVEL TO PARTICULAR DESTINATIONS, TRAVELFLY ADVENTURES DOES NOT REPRESENT OR WARRANT THAT TRAVEL TO SUCH POINTS IS ADVISABLE OR WITHOUT RISK, AND SHALL NOT BE LIABLE FOR COSTS, DAMAGES, OR LOSSES THAT MAY RESULT FROM TRAVEL TO SUCH DESTINATIONS. CLIENT’S PARTICIPATION CONSTITUTES ACCEPTANCE OF SUCH EVENTS AT CLIENT’S OWN RISK.
TRAVEL INSURANCE: TravelFly Adventures offers access to many optional products and services to enhance every travel experience. Options such as travel insurance protect passengers and their investments. Unless specifically noted, travel insurance is not included in the cost of the itinerary to protect against third-party supplier default/bankruptcy protection, delay, interruption; missed connection for cruises, cancellation, medical emergency transportation/evacuation, repatriation, and baggage and personal effects lost or delay, illness, job loss protection, accidental death and disability, travel accident/sickness medical expenses, and more. Proper insurance may protect you from financial loss in almost all circumstances. Without appropriate travel insurance, Customer understands and agrees that if Customer cancels or interrupts Customer’s travel for any reason, portions of the trip/tour may not be refunded, and TravelFly and travel suppliers cancellation penalties will apply resulting in the loss of monies up to the full cost of Customer’s travel booking and related costs. The purchase of travel insurance is not required in order to purchase any other product or service offered by TravelFly Adventures. Employees of TravelFly Adventures are not qualified or authorized to answer technical questions about benefits, exclusions, and conditions of any of the insurance offered, nor evaluate the adequacy of the prospective insured’s existing insurance coverage. An additional charge applies for travel insurance selected.
PHOTOGRAPHS/VIDEOS: TravelFly Adventures reserves the right to use any photograph/video taken at any event or during any travel activity, without the express written permission of those included within the photograph/video. TravelFly Adventures may use the photograph/video in publications or other media material produced, used, or contracted by TravelFly Adventures, including but not limited to: brochures, invitations, books, newspapers, magazines, television, websites, etc. Any person desiring not to have their photo taken or distributed must contact TravelFly Adventures in writing at thetravelflygroup@gmail.com of his/her intentions and include a photograph.
HAZARDOUS MATERIALS Federal law prohibits passengers from bringing hazardous materials on the aircraft.(1) Federal law forbids the carriage of hazardous materials aboard aircraft in the passenger’s luggage or on the passenger’s person. A violation can result in five years’ imprisonment and penalties of $250,000 or more (49 U.S.C. 5124). Hazardous materials include explosives, compressed gases, flammable liquids and solids, oxidizers, poisons, corrosives, and radio-active materials. Examples: Paints, lighter fluid, fireworks, tear gases, oxygen bottles, and radiopharmaceuticals.
(2) There are special exceptions for small quantities (up to 70 ounces total) of medicinal and toilet articles carried in the passenger’s luggage and certain smoking materials carried on the passenger’s person. For further information, each passenger should contact the relevant airline representative(s) on their itinerary. Restrictions on hazardous materials are listed http://www.tsa.gov/.
INSECTICIDE NOTICE We recommend that you refer to the DOT list of airports in countries that require airlines to treat the passenger cabin with insecticides prior to the flight or while on the aircraft. This list is on the DOT’s website and is updated from time to time: http://www.dot.gov/.
AIRLINES: AIR TRAVEL, SCHEDULE RECONFIRMATION, CHECK-IN
Your airline ticket is a contract between you and the air carrier, even if you purchase through TravelFly Adventures. If you purchase air travel through TravelFly Adventures, you acknowledge and agree that TravelFly Adventures does not have the right to control the operations of independent airlines, and agree that TravelFly Adventures is not liable for any personal injury, property damage related to your purchase of air tickets or air travel, including, but not limited to any act, error, omission, injury, loss, accident, or delay caused by any act, error or omission of the airline, including their failure to deliver services, partial or inadequate delivery of services, airline policies including refund or rebooking policies, fees for checked or carry-on luggage, fuel increases, bankruptcy or cessation of operations.
TravelFly Adventures shall not assume any responsibility for any air schedule changes. In rare instances, upon departure from a country, certain departure taxes must be paid in cash only and may vary in price. Failure to use a reservation may result in automatic cancellation of all continuing and return flights, as well as forfeiture of airfares.
Airline e-tickets expire a year from the issue date unless carrier fare rules in a passenger’s itinerary fare provide otherwise.
Due to enhanced security, it is strongly recommended that you check in a minimum of 2 hours prior to scheduled departure for domestic flights and 3 hours prior to scheduled departure time for international flights. Reconfirm flight times at least 24 hours prior to scheduled departure time for domestic flights, and 72 hours prior for international flights.
By checking in for a flight, tour, or cruise, you may be agreeing to additional terms and conditions imposed by the Supplier. If you have authorized TravelFly Adventures to check you in for any component of your trip, you take full responsibility for agreeing to and complying with the Supplier’s terms and conditions of check-in.
Frequent Flyer mileage accrual is at the discretion of the airline(s). TravelFly Adventures has no liability if accrual of miles or points is denied or if upgrades are not allowed. Many airlines do not permit upgrades on airfare purchased in certain fare classes or when using frequent flyer miles, loyalty status, or certificates.
Seat assignments are not guaranteed even after they are assigned, and TravelFly Adventures has no control over airline seat assignments. Most airlines charge a fee to pre-book a seat.
IMMUNIZATIONS AND HEALTH SCREENINGS
You must have the proper immunizations and health screenings and required documentation of such immunizations and screenings before travel. TravelFly Adventures shall not assume responsibility for the accuracy of health, vaccination, or documentation requirements prior to departure or upon landing at the final destination. In some cases, required inoculations must be recorded by the Client's health practitioner on a valid vaccination certificate, which the Client must carry for proof of inoculation. If you are concerned about taking any medications or receiving certain inoculations, check with your health practitioner BEFORE booking. Check the State Department Web site http://travel.state.gov, for relevant information relating to travel to specific destinations, and the Center for Disease Control http://wwwnc.cdc.gov/travel/ relating to health issues related to travel.
RELEASE FROM LIABILITY: TravelFly Adventures does not own or operate any entity, which is to or does provide goods or services for your trip. This includes, for example, ownership or control over hotels or other lodging facilities, airline, vessel, bus, van or other transportation companies, local ground operators, providers, or organizers of optional excursions or equipment used thereon, food service or entertainment providers, etc. All such persons and entities are independent contractors. As a result, TravelFly Adventures is not liable for any negligent or willful act or failure to act of any such person or entity, or of any other third party. Without limitation, TravelFly Adventures is not responsible for any of the following: injury, loss, or damage to person or property, death, delay, or inconvenience in connection with the provision of any goods or services occasioned by or resulting from, but not limited to, acts of God, acts of government, force majeure, acts of war or civil unrest, insurrection or revolt, strikes or other labor activities, criminal or terrorist activities of any kind. We are also not responsible for the threat thereof, overbooking or downgrading of accommodations, structural or other defective conditions in hotels or other lodging facilities, mechanical or other failure of airplanes or other means of transportation or for any failure of any transportation mechanism to arrive or depart timely or safely, dangers associated with or bites from animals, pests or insects, marine life or vegetation of any sort, dangers incident to recreational activities such as swimming, kayaking, sailing, canoeing, rafting, hiking, walking, bicycling, etc., sanitation problems, food poisoning, lack of access to or quality of medical care, difficulty in evacuation in case of a medical or other emergency, illness, epidemics or the threat thereof or for any other cause beyond the direct control of TravelFly Adventures. In addition, I release TravelFly Adventures from its own negligence and assume all risk thereof.
GENERAL: These Terms and Conditions (and any other terms and conditions referenced herein), constitute the entire agreement between the Customer and TravelFly Adventures with respect to travel bookings made with TravelFly Adventures by any means accessing such information, including its Web site, and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between Customer and TravelFly Adventures with respect to communications with TravelFly Adventures, including the TravelFly Adventures web site. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to these Terms and Conditions to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.
LIMITATIONS OF RESPONSIBILITY, DISCLOSURE, AND LIABILITY TravelFly Adventures acts solely as a booking agent for disclosed principal Suppliers and is not the source or provider of any travel service. Each Supplier is an independent entity with its own management and is not subject to the control of TravelFly Adventures. The Suppliers whose names appear in travel documentation are those actually responsible for providing the travel services purchased, and you consent to the use of those Suppliers.
Some group tours are based on minimum numbers of passengers traveling; if the number of passengers falls below the minimum required, a surcharge may be imposed, or the tour may be canceled. Any cancellations of a tour or package for reason of failing to meet the minimum traveler requirement will be governed by the tour operator’s cancellation policy.
The Supplier may determine that alterations in the itinerary are necessary for any number of reasons, including but not limited to severe weather. Any alterations to an itinerary are at the sole discretion of the Supplier, and TravelFly Adventures bears no responsibility for any changes.
BECAUSE TRAVELFLY ADVENTURES ACTS AS AN AGENT FOR DISCLOSED PRINCIPAL SUPPLIERS AND DOES NOT HAVE THE RIGHT TO CONTROL THE OPERATIONS OF SUCH INDEPENDENT OPERATORS AND SUPPLIERS, YOU AGREE THAT TRAVELFLY ADVENTURES IS NOT LIABLE FOR ANY PERSONAL INJURY OR PROPERTY DAMAGE, WHICH MAY ARISE OUT OF THESE SERVICES. TRAVELFLY ADVENTURES HEREBY DISCLAIMS ANY LIABILITY WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION LIABILITY FOR ANY DIRECT, PUNITIVE, SPECIAL CONSEQUENTIAL, INCIDENTAL OR INDIRECT DAMAGES IN CONNECTION WITH THE GOODS OR SERVICES PROVIDED BY ANY PRINCIPAL SUPPLIER BOOKING THROUGH TRAVELFLY, INCLUDING WITHOUT LIMITATION LIABILITY FOR ANY ACT, ERROR, OMISSION, INJURY, LOSS, ACCIDENT, DELAY OR IRREGULARITY WHICH MAY BE INCURRED THROUGH THE FAULT, NEGLIGENCE, WILLFUL ACTS, OMISSIONS OR OTHERWISE OF SUCH SUPPLIER, OR OF ANY SUPPLIER OR THEIR RESPECTIVE EMPLOYEES, AGENTS, SERVANTS, OR REPRESENTATIVES, INCLUDING, WITHOUT LIMITATION, THEIR FAILURE T0 DELIVER 0R THEIR PARTIAL OR INADEQUATE DELIVERY OF SERVICES, THEIR CANCELLATlON AND REFUND POLICIES, FUEL INCREASES, BANKRUPTCY, OR CESSATION OF OPERATIONS AND OTHER MATTERS OUTSIDE OF TRAVELFLY’S CONTROL, AND YOU HEREBY EXONERATE TRAVELFLY ADVENTURES FROM ANY LIABILITY WITH RESPECT TO THE SAME.
TRAVELFLY ADVENTURES HAS SOLELY RECEIVED COMMISSION AND FEES FOR TRAVEL TRANSACTIONS AND CLIENT AGREES AND UNDERSTANDS THAT ANY RECOVERY FROM TRAVELFLY ADVENTURES WILL BE LIMITED TO THE AMOUNT OF COMMISSION AND FEES ACTUALLY RECEIVED BY TRAVELFLY ADVENTURES .
Groups:
- Group Leader Responsibilities:
- The appointed group leader is responsible for communicating all itinerary details, guidelines, and conduct expectations to group members. - It is the group leader’s duty to ensure that all participants adhere to requirements, including any necessary travel documents and health prerequisites.
- Behavior and Conduct:
- All group members must respect local customs and adhere to provided travel guidelines and safety measures. - TravelFly Adventures is not liable for any actions by group members that contravene these guidelines or local laws. Consequences from such actions rest with the involved individuals.
- Property Damages:
- Any damages to properties—such as accommodations, vehicles, or venues—incurred by group members will be the collective responsibility of the group. - The group leader will act as the liaison for communicating damages, and any costs incurred will be the responsibility of the responsible party/parties involved.
- Changes and Issues:
- Any issues or changes within the group should be conveyed through the group leader, who will serve as the primary point of contact with TravelFly Adventures. - While we are here to support, TravelFly Adventures is not responsible for resolving individual disputes or discrepancies within the group. By agreeing to these terms, both leaders and members acknowledge their responsibilities, ensuring a seamless and respectful journey for everyone involved.
MODIFICATION TO THESE TERMS: We are acting as an independent contractor and no joint venture, partnership or employment relationship exists between you and us or our Suppliers because of this agreement. We reserve the right, in our sole discretion, to change these Terms at any time.
